1. Introduction

These terms and conditions ("Terms") govern your use of the JUSTHIRE platform and all services arranged through it. By placing a booking or using our website, you confirm that you accept these Terms in full and agree to comply with them. If you disagree with any part of these Terms, you must not use our website or services.

2. Definitions

  • "JUSTHIRE," "we," "us," "our" refers to JUSTHIRE Ltd, the operator of the JUSTHIRE platform.
  • "Customer," "you," "your" refers to the person or entity placing a booking through the JUSTHIRE platform.
  • "Supplier" refers to the third-party company or individual that provides the Equipment or Services.
  • "Equipment" refers to any item hired through the platform, including but not limited to skips, containers, diggers, tools, machinery, vehicles, and any other hired goods.
  • "Services" refers to any work or service arranged through the platform, including but not limited to waste collection, landscaping, cleaning, tree surgery, groundworks, and any other professional or trade services.
  • "Hire Period" refers to the duration for which Equipment is hired, commencing on delivery and ending on collection.

3. Service Description

JUSTHIRE provides an online platform for booking Equipment hire and Services. We act as an intermediary between Customers and Suppliers. The Equipment and Services are provided by independent Suppliers, not by JUSTHIRE directly.

4. Booking and Payment

  • All prices shown include VAT unless otherwise stated.
  • Payment is required at the time of booking.
  • Booking confirmation will be sent via email.
  • Standard hire duration is up to 14 days unless otherwise specified. Any extension beyond the agreed Hire Period may incur additional charges.
  • Additional charges may apply for overweight loads, prohibited items, extended hire, failed collection due to access issues, or any other circumstances detailed at the time of booking.

5. Delivery and Collection

Delivery and collection dates are subject to availability. While we strive to meet all requested dates, these cannot be guaranteed. Any specific delivery or access requirements must be communicated at the time of booking.

You must ensure that the Equipment is accessible for collection at the end of the Hire Period. If collection is prevented due to blocked access, incorrect information, or other factors within your control, additional charges may apply.

6. Customer Responsibilities

You are responsible for:

  • Providing accurate and complete information at the time of booking, including delivery address, access details, and contact information.
  • Ensuring suitable and safe access for delivery, use, and collection of Equipment.
  • Obtaining any necessary permits, licences, or permissions required for the placement or use of Equipment or the carrying out of Services (for example, road permits for skips placed on public highways).
  • Using all Equipment safely, lawfully, and in accordance with any instructions, guidelines, or restrictions provided by the Supplier or JUSTHIRE.
  • Not overloading Equipment beyond its stated capacity or placing prohibited, hazardous, or restricted materials in any container or skip.
  • Keeping Equipment secure and protected from theft, vandalism, misuse, or damage throughout the Hire Period.
  • Not moving, relocating, or altering Equipment from its original delivery position without prior written consent.
  • Ensuring that third parties (including but not limited to neighbours, contractors, and members of the public) do not misuse, damage, or interfere with the Equipment.
  • Returning Equipment (where applicable) in the same condition as delivered, subject to fair wear and tear.

7. Damage, Loss, and Destruction of Equipment

You are responsible for the Equipment from the point of delivery until collection by the Supplier. This includes responsibility for any loss, theft, damage, or destruction of the Equipment during the Hire Period, howsoever caused, including but not limited to:

  • Fire (including arson and accidental fire).
  • Weather-related damage (including extreme heat, storms, flooding, and wind).
  • Vandalism or deliberate damage by any person.
  • Theft or attempted theft.
  • Damage caused by overloading, misuse, or the deposit of prohibited or hazardous materials.
  • Collision or impact damage from vehicles or other objects.
  • Any other damage occurring while the Equipment is in your possession or at the delivery location.

In the event of loss, theft, damage, or destruction, you may be liable for the full cost of repair or replacement of the Equipment, as determined by the Supplier. We strongly recommend that you arrange adequate insurance cover for any Equipment hired through the platform for the duration of the Hire Period.

You must notify us and the Supplier promptly of any damage, loss, theft, or incident involving the Equipment.

8. Prohibited Items and Materials

Where Equipment is provided for waste disposal or storage (such as skips or containers), the following materials must not be placed in the Equipment unless expressly agreed in writing:

  • Hazardous or toxic waste (including asbestos, chemicals, solvents, paints, oils, and batteries).
  • Electrical or electronic equipment (WEEE).
  • Gas cylinders, pressurised containers, or explosives.
  • Tyres, mattresses, or fridges (unless agreed at booking).
  • Clinical or medical waste.
  • Liquids, food waste, or putrescible materials.
  • Any materials that are illegal to dispose of in this manner.

If prohibited items are found, additional removal and disposal charges will apply and will be charged to you.

9. Cancellation Policy

Cancellations must be made at least 24 hours before the scheduled delivery or service commencement time. Refunds may be subject to an administration fee.

Permits are non-refundable due to council fees being non-refundable.

If you cancel after Equipment has been dispatched or a Supplier has been mobilised, you may be liable for delivery, collection, or mobilisation costs.

10. Our Right to Cancel or Amend Bookings

We reserve the right to cancel or amend bookings at our discretion, including due to Supplier issues, operational constraints, safety concerns, or unforeseen circumstances. In the event of a cancellation by us, you will receive a full refund. We will not be liable for any consequential losses, delays, or additional costs incurred as a result.

11. Liability

Our Liability

JUSTHIRE acts as an intermediary platform. Our total liability to you in connection with any booking shall not exceed the total amount paid by you for that booking.

We are not liable for any indirect, consequential, or special losses arising from the use of our platform or services, including but not limited to loss of profit, loss of business, property damage, or personal injury (except where such liability cannot be excluded by law).

We do not accept liability for the acts, omissions, quality of work, or conduct of any Supplier. Any disputes regarding the quality or performance of Equipment or Services should be raised with us so that we can liaise with the Supplier on your behalf, but our role is limited to facilitation.

Your Liability

You are liable for any damage to, loss of, or destruction of Equipment during the Hire Period as set out in Section 7 above.

You agree to indemnify and hold JUSTHIRE and its Suppliers harmless against any claims, losses, damages, costs, or expenses (including legal fees) arising from your breach of these Terms, your misuse of Equipment, or any third-party claims related to your use of the Equipment or Services.

12. Insurance

Equipment hired through the platform is not automatically covered by insurance. It is your responsibility to arrange adequate insurance for any Equipment during the Hire Period, covering (at minimum) fire, theft, accidental damage, and third-party liability.

We strongly recommend checking with your home or business insurance provider to confirm whether hired equipment on your property is covered under your existing policy.

13. Force Majeure

Neither JUSTHIRE nor the Supplier shall be liable for any failure or delay in performing obligations where such failure or delay results from circumstances beyond reasonable control, including but not limited to natural disasters, extreme weather, fire, flood, epidemic, pandemic, government action, war, terrorism, civil unrest, strikes, or disruption to transport or utilities.

For the avoidance of doubt, force majeure does not relieve you of your responsibility for Equipment in your possession. You remain liable for loss, damage, or destruction of Equipment during the Hire Period regardless of the cause, as set out in Section 7.

14. Privacy and Data Protection

We are committed to protecting your privacy. Please refer to our Privacy Policy for details on how we collect, use, and protect your personal information.

15. Complaints and Disputes

If you have a complaint regarding any Equipment or Service, please contact us as soon as possible. We will endeavour to resolve any issues promptly and fairly by liaising with the relevant Supplier.

If a dispute cannot be resolved informally, it may be referred to mediation or, where applicable, the relevant ombudsman or small claims procedure.

16. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

17. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated revision date. Your continued use of the platform after changes are posted constitutes acceptance of the revised Terms.
